Welcome to Fakhama Engraved. These Terms of Service ("Terms") govern your use of our website [fakhamaengraved.com] and your purchase of customized luxury pens and related products. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website.

Fakhama Engraved is an e-commerce store based in the Kingdom of Saudi Arabia (KSA). Our services are intended for customers in KSA and comply with KSA laws and regulations, including the E-Commerce Law and the PDPL.

1. ACCOUNT TERMS

1.1 Account Registration
To place an order, you may be required to create an account. You agree to provide accurate, complete, and current registration information. You are solely responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

1.2 Account Responsibility
You must notify us immediately of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account information.

1.3 Account Suspension
We reserve the right to suspend or terminate your account at our sole discretion if we suspect any violation of these Terms, fraudulent activity, or any breach of applicable KSA laws.

1.4 Age Requirement
You must be at least 18 years old or the age of legal majority in your jurisdiction to use our website and place orders. By using our site, you represent that you meet this requirement.

2. PRICING AND PAYMENT

2.1 Pricing
All prices listed on our website are in Saudi Riyals (SAR) unless otherwise stated. Prices are subject to change without notice. However, the price displayed at the time you place your order will be honored, subject to order acceptance under Section 4 below.

2.2 Taxes and Fees
All prices are inclusive of Value Added Tax (VAT) at the applicable KSA rate, currently 15% as required by ZATCA (General Authority of Zakat and Tax). Shipping fees, if any, will be added to your total and clearly displayed before checkout.

2.3 Payment Methods
We accept payment via BankTransfers. You represent that you are authorized to use the selected payment method.

2.4 Payment Security
All payment transactions are processed through secure, PCI-compliant payment gateways. We do not store your full credit card information on our servers.

2.5 Order Total
The total order amount will include the product price, applicable taxes, shipping fees, and any other charges clearly disclosed before you confirm your purchase.

3. PRODUCT DESCRIPTIONS

3.1 Accuracy of Information
We strive to ensure that product descriptions, images, pricing, and engraving samples displayed on our website are accurate and up to date. However, we do not warrant that product descriptions, images, or other content are completely error-free, as screen displays may vary.

3.2 Personalized Products
All pens sold by Fakhama Engraved are customized products that require you to provide a name or text for engraving. You are solely responsible for the accuracy of the engraving information you submit. Please double-check all names, spellings, and formats before finalizing your order, as we begin engraving immediately after order confirmation.

3.3 Variation in Customization
Due to the handmade and engraved nature of our products, minor variations in engraving depth, alignment, or finish may occur. These variations are considered normal and do not constitute a defect.

3.4 Defective Products
If you receive a product with a manufacturing defect (e.g., the pen does not write, the engraving is illegible due to our error), we will replace or refund it in accordance with Section 7.

4. ORDER ACCEPTANCE

4.1 Acknowledgment vs. Acceptance
When you place an order, you will receive an email acknowledgment confirming that we have received your order. This acknowledgment does not constitute acceptance of your order.

4.2 Acceptance of Order
Your order is accepted and a binding contract is formed only when we send you a shipping confirmation email or when the order is dispatched, whichever occurs first. We reserve the right to refuse or cancel any order for any reason, including but not limited to product unavailability, pricing errors, suspected fraud, or violation of these Terms.

4.3 Right to Cancel Orders
If we cancel an order after payment has been processed, we will issue a full refund to your original payment method within [5 to 7] business days.

4.4 Invoice Provision
After a contract is concluded via electronic means, we will provide you with an invoice that clearly shows the cost of each product, total price (including taxes and delivery fees, if any), delivery date, and delivery location.

5. SHIPPING AND DELIVERY

5.1 Delivery Commitment
We will make every effort to deliver your order within the estimated time frame provided at checkout. However, actual delivery times may vary due to factors beyond our control, such as courier delays or force majeure.

5.2 Delivery Delay – Your Rights
Under Article 14 of the Saudi E-Commerce Law, if we delay delivery beyond 15 days from the agreed delivery date (or from the date of order confirmation if no specific date was agreed upon), you have the right to cancel the contract and receive a full refund of the amount you paid, unless the delay was caused by a force majeure event.

5.3 Risk of Loss
Ownership and risk of loss for the products pass to you upon delivery to the shipping carrier. We are not responsible for any loss, damage, or delay caused by the carrier after dispatch.

5.4 Shipping Costs
Shipping costs are calculated based on your location and selected shipping method. These costs will be clearly displayed before you complete your purchase.

5.5 Delivery Area
We currently ship only Eastern Region. all cities within the Kingdom of Saudi Arabia. For international shipping inquiries, please contact us at growmore.admin@gmail.com.

6. RETURNS AND REFUNDS

6.1 Your 7-Day Right to Cancel
Under Article 13 of the Saudi E-Commerce Law, as a consumer, you have the right to cancel the purchase contract within seven (7) calendar days from the date you receive the product, provided you have not used the product or benefited from the service provided. If you cancel within this period, you must return the product in its original condition, unused and with original packaging. You will be responsible for the return shipping costs, unless we agree otherwise.

6.2 Exceptions to the 7-Day Cancellation Right
Under Saudi E-Commerce Law, the 7-day cancellation right does not apply to the following categories:

  • Customized products: Products made to your specifications or clearly personalized – this includes all engraved pens with custom name stamping, as our pens are manufactured according to your specific requirements.

  • Sealed goods (e.g., audio/video recordings, software) that have been unsealed after delivery.

  • Newspapers, magazines, or periodicals.

  • Perishable goods.

  • Services that have already been performed.

Therefore, because our pens are personalized with your chosen engraving, the 7-day cancellation right does NOT apply once the order has been processed for engraving. Please confirm your engraving details carefully before placing your order.

6.3 Defective or Wrong Product Returns
If you receive a product that is defective (manufacturing flaw affecting function) or does not match the engraving specifications you provided (due to our error, not yours), please contact us within [7 days] of receipt. We will, at our option, repair, replace, or refund the product, and we will cover return shipping costs in such cases.

6.4 Return Process
To initiate a return, please contact us at growmore.admin@gmail.com with your order number and a clear description of the issue. We will provide you with return instructions. Returns sent without prior authorization may not be accepted.

6.5 Refund Timeline
Once we receive and inspect the returned product (where applicable), we will process your refund within [7 to 10] business days to your original payment method.

7. PROHIBITED USES

In addition to other prohibitions set forth in these Terms, you are prohibited from using the website or its content:

  • For any unlawful purpose or to solicit others to perform or participate in any unlawful acts under KSA law.

  • To violate any applicable laws or regulations, including but not limited to the KSA E-Commerce Law, the Anti-Cyber Crime Law, the Personal Data Protection Law (PDPL), and the Intellectual Property Law.

  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.

  • To submit false or misleading information, including incorrect engraving details, with the intent to cause harm or fraud.

  • To upload or transmit viruses or any other type of malicious code that may affect the functionality or operation of our website.

  • To harass, abuse, insult, harm, defame, slander, or discriminate based on gender, religion, ethnicity, or any other protected characteristic.

  • To collect or track the personal information of others without their consent.

We reserve the right to terminate your use of the website for violating any of the prohibited uses.

8. LIMITATION OF LIABILITY

8.1 Disclaimer of Warranties
To the maximum extent permitted by KSA law, our products and website are provided "as is" without any warranties, express or implied, other than the statutory warranties provided under the Saudi E-Commerce Law.

8.2 Limitation of Liability
To the maximum extent permitted by KSA law, Fakhama Engraved, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our website or products.

  • Any unauthorized access to or use of our servers and/or any personal information stored therein.

  • Any bugs, viruses, or other harmful code that may be transmitted to or through our website.

8.3 Maximum Liability
Our total liability to you for any claim arising out of or relating to these Terms or your purchase of our products shall not exceed the total amount you paid to us for the specific product giving rise to the claim.

8.4 Consumer Rights
Nothing in this Section 8 limits or excludes any statutory consumer rights that cannot be waived under KSA law, including your right to receive products that conform to the contract and your rights related to defective products.

9. GOVERNING LAW AND DISPUTE RESOLUTION

9.1 Governing Law
These Terms and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, including the Saudi E-Commerce Law (2019), the Civil Transactions Law, and the Personal Data Protection Law (PDPL), without regard to its conflict of law provisions.

9.2 Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or your purchase of our products shall first be attempted to be resolved through good-faith negotiation between the parties.

9.3 Legal Action
If the dispute cannot be resolved through negotiation within [30 days], either party may pursue legal action. You agree that any legal proceedings shall be brought exclusively in the courts of [Jeddah/Riyadh, Saudi Arabia] , and you consent to the personal jurisdiction of such courts.

9.4 Ministry of Commerce Complaint
As a consumer in Saudi Arabia, you also have the right to file a complaint with the Ministry of Commerce (via the "Report a Commercial Violation" service on the Ministry's website) or through the Commercial Complaint service available on the National Platform (my.gov.sa).
